Luxury Transportation & Concierge Services
These Terms & Conditions (“Terms”) govern your use of the website located at www.blackcardconcierge.net (the “Website”) and your engagement of services from Black Card Concierge (“Company,” “we,” “us,” or “our”). By accessing the Website or booking a reservation, you (“Client,” “you,” or “your”) agree to be bound by these Terms. Specific service engagements are additionally governed by Black Card Concierge's Master Client Service Agreement, which is incorporated by reference and controls in the event of any conflict with these Terms.
1. Services Offered
Black Card Concierge provides chauffeured luxury ground transportation using a black luxury SUV and other luxury vehicles as assigned, along with concierge and lifestyle-management services including hotel and restaurant reservations, event coordination, VIP and red-carpet experience planning, and other bespoke arrangements as agreed in writing between the Parties.
2. Use of the Website
- You must be at least 18 years of age to book Services through the Website.
- You agree to provide accurate, current, and complete information when submitting a reservation or inquiry.
- You agree not to use the Website for any unlawful purpose or in any manner that could damage, disable, or impair the Website or interfere with any other party's use of it.
- All content on the Website, including text, graphics, logos, and images, is the property of Black Card Concierge and may not be reproduced or used without prior written consent.
3. Reservations & Confirmation
All reservations must be requested in writing through the Website, by email, or by text, and are confirmed only upon Company's written confirmation and receipt of any required payment or deposit. Client is responsible for providing accurate pickup location, destination, date, time, passenger count, and any special requests at the time of booking.
4. Payment Terms
Full payment is due prior to the rendering of Services unless Company has expressly agreed to alternate terms in writing. Payments are processed securely through Company's designated payment processor. All rates quoted are exclusive of applicable tolls, parking, and gratuity unless stated otherwise. Gratuity is not included in the base rate unless disclosed on the invoice or booking confirmation.
5. Cancellation & Refund Policy
- Cancellations made 48 hours or more prior to the scheduled service receive a full refund or, at Client's option, a no-charge reschedule.
- Cancellations made between 24 and 48 hours prior to the scheduled service incur a cancellation fee of 50% of the total service charge.
- Cancellations made less than 24 hours prior to the scheduled service, or any no-show, are non-refundable.
- Deposits for special events, holiday bookings, and large corporate or VIP engagements are non-refundable once a chauffeur, vehicle, and any third-party vendor arrangements have been confirmed and secured.
6. Client Conduct
Client is responsible for the conduct of all passengers traveling under a reservation. Company reserves the right to terminate service immediately, without refund, in the event of behavior that is abusive, threatening, illegal, or that endangers the chauffeur, vehicle, or other passengers. Client is financially responsible for any damage, excessive soiling, or biological cleanup caused during the course of service, subject to the fee schedule set forth in the Master Client Service Agreement.
7. Third-Party Vendors
Where Company facilitates services provided by third-party vendors, including hotels, restaurants, event venues, and affiliate transportation partners, Company acts solely as a booking facilitator and is not responsible for the acts, omissions, quality, or performance of any third-party vendor. Client's recourse for any such issue lies with the third-party vendor directly.
8. Force Majeure
Company is not liable for delays, cancellations, or inability to perform caused by events of force majeure, including severe weather, natural disaster, road closures, traffic accidents, civil unrest, government action, or other circumstances outside Company's reasonable control. In such events, Company will work in good faith with Client to reschedule service or issue an appropriate credit.
9. Limitation of Liability
Company's total liability arising out of or related to these Terms or the Services, whether in contract, tort, or otherwise, shall not exceed the total amount paid by Client for the specific service giving rise to the claim. Company is not liable for indirect, incidental, consequential, or punitive damages, except where such limitation is prohibited by law.
10. Indemnification
Client agrees to indemnify, defend, and hold harmless Black Card Concierge, its owners, chauffeurs, employees, and affiliates from and against any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of Client's or Client's passengers' breach of these Terms, violation of law, or misconduct during the course of service.
11. Intellectual Property
The Black Card Concierge name, logo, and all related trademarks, service marks, and brand assets are the exclusive property of Black Card Concierge. Nothing in these Terms grants you any right to use such marks without Company's prior written consent.
12. Third-Party Payment Processing
Payments are processed through Company's designated third-party payment processor. Use of the payment processor is subject to that provider's own terms of service, and Company is not responsible for the availability or performance of third-party payment systems.
13. Electronic Signature
The Parties agree that service agreements may be executed electronically and that an electronic signature, including a signature captured via DocuSign or a comparable platform, shall be legally binding and enforceable to the same extent as a handwritten signature.
14. Dispute Resolution
The Parties agree to first attempt to resolve any dispute arising out of these Terms through good-faith negotiation. If a dispute cannot be resolved informally within thirty (30) days, the Parties agree to submit the dispute to mediation prior to pursuing litigation. This provision does not limit either Party's right to seek injunctive relief where appropriate.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict-of-law principles. Venue for any legal proceeding shall lie exclusively in the state or federal courts located in Fulton County, Georgia.
16. Changes to These Terms
Company may update these Terms from time to time. The updated version will be posted on the Website with a revised effective date. Continued use of the Website or the Services after changes are posted constitutes acceptance of the revised Terms.
